JJ's mother files defence to widow's joint matrimonial asset claim
Aminah Abdullah (photo), the mother of the late former minister, Jamaluddin Jarjis, has today filed her defence in objecting to his widow Kalsom Ismail's harta sepencarian (joint matrimonial asset) claim at the Syariah High Court in Kuala Lumpur.
This follows Kalsom's claim filed last month, for at least half of the joint matrimonial assets. However, the detailed quantum of the assets is not known.
The case management took place today before the Syariah High Court registrar Siti Zulaikha Mohamad Mansor today.
Lawyer Shamsuriah Sulaiman appeared for Kalsom while Nur Hidayah A Bakar appeared for Aminah.
The case is fixed for mention on Jan 7 for Aminah to reply to Kalsom's preliminary objection to the 84-year-old's faraid (Islamic wealth distribution) claim.
It was reported last month that negotiations between both parties had failed as Aminah had filed a faraid claim while Kalsom filed her joint matrimonial asset claim.
Harta sepencarian or joint matrimonial assets are assets gained by the couple during their years of marriage.
Under Islamic law, if a deceased does not leave a will, the mother is entitled to receive one-sixth of the decedent's estate, while his widow gets one-eighth and the children would receive the remainder.
Aminah filed her faraid claim last March for the Syariah Court to declare that she is to be one of the rightful claimants to Jamaluddin estate. She and her lawyers estimated the assets are worth close to RM2.1 billion.
The mother listed landed properties – including houses in Malaysia, Saudi Arabia, and in the United States – as part of the estate. The estate also includes shares owned by the late minister and those purportedly given to her grandchildren.
In total, the assets comprise 22 landed properties, mostly in Pahang and in the Klang Valley, 21 bank accounts with a total sum of more than RM15 million – including one account in the US – and shares in 15 companies.
Jamaluddin, formerly Rompin MP, and Science Technology and Innovation Minister, as well as one time Malaysia's ambassador to the United States, was said to be a close confidant of former prime minister Najib Abdul Razak and had held various cabinet posts.
He and several others, including Najib's private secretary, Azlin Alias, died in a helicopter crash on April 4, 2015, where the report of the incident said it was the result of pilot negligence. - Mkini
