Minister: We're fixing rules to help 'referee' make right call on emergency


 


De facto law minister Takiyuddin Hassan has denied that the cabinet was "shifting goalposts" as to when the emergency period should come to an end.

Instead, he said the cabinet was only "correcting" rules to help the "referee" make the right decision.

"No one is shifting the goalposts. What's being done is correcting the rules of the game to help the referee make the right call.

"'To achieve goals does not mean to change the goalposts," he said in a tweet last night.

It is not clear what he meant by "correcting" the rules.

Takiyuddin was responding to Dewan Rakyat deputy speaker Azalina Othman Said who criticised his remarks that the cabinet would advise the Yang di- Pertuan Agong on whether the emergency should be extended or not.

Azalina and others have argued that advising the king on when to end the emergency is the job of an independent special committee set up for that purpose.

Established under Section 2(1) of the Emergency Ordinance 2021, the 19-member independent committee has one job - to advise the Agong on when the emergency should end.

Lawyer Haniff Khatri argued that since the committee's role was enshrined under the ordinance, the government had shifted the responsibility for advising the king on extending the emergency away from the cabinet to the committee.

The emergency period - declared to fight rising Covid-19 cases - is tentatively set to end on Aug 1.

Takiyuddin had remarked on the cabinet's role to advise the Agong on the end date in response to Health director-general Dr Noor Hisham Abdullah.

Noor Hisham was cited by the Malay Mail as saying that the king had the discretion to decide on the end date.

Prior to the January emergency declaration, the king had in October last year rejected a bid by the government then to declare an emergency. - Mkini
