Speed up probe on ‘court decision can be fixed’ claim, cops told


 

A special officer to Chief Justice Tengku Maimun Tuan Mat lodged a police report against a lawyer for allegedly suggesting a court decision can be arranged.

PETALING JAYA: A lawyer has urged police to quickly wrap up their investigation into a report by a special officer of the chief justice against a senior lawyer for allegedly suggesting that a court decision could be fixed.

Syed Iskandar Jaafar al-Mahdzar said the investigation papers should be referred to the Attorney-General’s Chambers for them to decide if there was a charge to be filed in court.

“It is a serious allegation that a Malaysian lawyer can inform a foreign company that he has covered the path up to the CJ,” Syed Iskandar said.

He was responding to a report lodged on June 7 by an unidentified officer to Chief Justice Tengku Maimun Tuan Mat over text messages that could potentially bring the judiciary into disrepute.

FMT understands that the police report disclosed that among the text messages was one to a foreign client stating “the path is covered till the CJ”.

It is learnt that the messages were in connection with two civil appeals pending before the Court of Appeal.

FMT has also reached out for an update from Sepang district police chief Wan Kamarul Azran Wan Yusof.

It is understood that the investigation was being conducted under Section 233 (1) (a) of the Communications and Multimedia Act for improper use of network facilities, Section 500 of the Penal Code for defamation, and Section 504 of the same law for intentional insult to provoke a breach of peace.

On June 20, two prominent lawyers, Lim Chee Wee and Rosli Dahlan, lodged police reports denying any knowledge of the text messages that mentioned their names and spoke of matters that allegedly sully the judiciary’s image.

Police are understood to have recorded statements from eight witnesses, including three lawyers and a former legal director of the Malaysian branch of the foreign company. Investigators have seized her mobile phone and a laptop.

Syed Iskandar said police should also confiscate the mobile phone of the lawyer implicated in the report and there should be no influence from any quarters.

“Police should ask their Norwegian counterparts for assistance to investigate the state of affairs of the foreign company and trace the messages,” he said.

Meanwhile, lawyer A Srimurugan said the investigation was of national importance because the credibility and integrity of the judiciary was being questioned overseas.

He said although the report was made by an officer, it was “akin to Tengku Maimun, as head of the judiciary, lodging it”, and police must treat the case seriously.

“Police must communicate their findings to the AGC who must inform the people of the final outcome since this is a public interest case,” he said.

Srimurugan said Tengku Maimun had worked hard to improve public confidence in the judiciary since her appointment two years ago.

“It had taken several beatings in the past, the latest being an explosive affidavit filed by a senior judge in support of a suit,” he said.

Three years ago, Court of Appeal judge Hamid Sultan Abu Backer alleged that there was judicial interference in several high-profile cases.

In February, the Judges’ Ethics Committee suspended him until his retirement next month.

Hamid refused to attend a hearing by the committee as he wanted to challenge its composition and legal standing. - FMT
