Wherever I go now, the most frequently asked question is why the former Prime Minister, Datuk Seri I Mappadulung Daeng Mattimung Karaeng Sandrobone Sultan Abdul Jalil), Mohd Najib Abdul Razak is not asked to wear the Malaysian Anti-Corruption Commission’s (MACC) lock-up shirt.
Also “exempted” from wearing the uniform is his wife, Datin Paduka Seri Puan Reno Rosmah Mansor.
If ordinary people ask, I’m not surprised. But lawyers, prosecutors and cabinet ministers also ask.
Some people said they did not wear the uniform because they were not remanded while others said, there is no danger of escaping.
Some people ask whether this is favoritism or there is some party supporting them?
But all say it is not fair for Najib and Rosmah to be exempted. It is better not to make up excuses for why they do not have to show up in the uniform.
But why not. Some of Najib’s senior leaders like (Tan Sri) Isa Samad, (Datuk Seri Panglima) Abdul Azeez Rahim, Datuk Hasanah Abdul Hamid and (Datuk) Rizal Mansor were in “orange”.
I’m not sure if Datuk Seri (Tengku) Adnan Mansor was also in “orange”. But I don’t think so. If I’m not mistaken, he wore a blue batik shirt.
Many more MACC cases await Najib and Rosmah. So we wait and see whether the public’s wish to see Najib and Rosmah be made to wear the orange uniform will materialize.
Right to speak
Then people ask about Najib continuing to make statements as if he were still the Prime Minister and his refusal to enter the dock during the case management session at the Kuala Lumpur Sessions Court on November 16.
Regarding Najib’s statements, I think it’s his right. He’s still free and we respect freedom of speech. My advice, if it makes you feel nauseous and want to vomit do not read his comments.
This is the story of how people scared of ghosts behave when alone on dark nights. The more he is afraid, the more loudly he sings or talks to himself.
Due to his refusal to enter the dock, there are people, including lawyers, who say his actions are insulting the court. Westerners call it “contempt of court”.
My research finds that under Article 26 of the Third Schedule (Section 99A) of the Subordinate Courts Act 1947, the accused of contempt of court may be subject to a maximum jail term of three weeks or a fine.
But I think his refusal to enter the dock was to test the patience of the judge and to challenge the court rules.
It is customary in a trial for the accused and their lawyers to use a variety of tricks and technical issues to delay proceedings and thus create doubt.
We have seen how this method was used extensively in serious or sensational cases, especially those involving politicians and other dignitaries.
From false accusations to abdominal pain, heart disease, sore eyes and more. Then change the lawyer. Then raise objections to this and that.
Meticulous court process
The court process is usually slow as the court needs to be careful. There are four levels of courts that must be passed before a person undergoes punishment.
In Najib’s case, his trial will undoubtedly be transferred from the Sessions Court to the High Court. If he is found guilty by the High Court, he can appeal to the Court of Appeal. If he loses in the Court of Appeal, he can appeal to the Federal Court. If he loses, then he goes to prison.
So, my advice is we should not put too much hope on seeing Najib, Rosmah and their allies thrown into jail too soon.
If it is fated the Prosecutor wins, I think we can give some special privilege to Najib.
We will allow him to be taken to Sungai Buloh or Kajang Prison by MRT because coincidentally or not, he chose to build the MRT line between Sungai Buloh and Kajang, both of which have jails.

Najib Tak Pakai Seragam Oren Dipertikai

KE MANA pun saya pergi sekarang, soalan yang kerap ditanya adalah mengapa bekas Perdana Menteri, Datuk Seri I Mappadulung Daeng Mattimung Karaeng Sandrobone Sultan Abdul Jalil), Mohd Najib Abdul Razak tidak dipakaikan kemeja-T oren lokap Suruhanjaya Pencegahan Rasuah Malaysia (SPRM).
Turut “dikecualikan” daripada memakai pakaian seragam itu adalah isterinya, Datin Paduka Seri Puan Puti Reno Rosmah Mansor.
Kalau orang biasa yang tanya, saya tak hairan sangat. Ini peguam, pendakwa raya dan menteri kabinet pun tanya.
Ada orang kata, mereka tidak dipakaikan uniform tersebut kerana mereka tidak dikenakan tahanan reman manakala yang lain pula kata, kerana tidak ada bahaya mereka melarikan diri.
Ada yang tanya adakah ini pilih kasih atau ada lagi pihak yang memihak kepada mereka?
Tapi semua kata adalah tidak adil Najib dan Rosmah dikecualikan. Lebih tidak patut kalau alasan sengaja dibuat supaya mereka tidak perlu memperagakan pakaian seragam itu.
Betapa tidak. Beberapa orang kanan Najib seperti (Tan Sri) Isa Samad, (Datuk Seri Panglima) Abdul Azeez Rahim, Datuk Hasanah Abdul Hamid dan (Datuk) Rizal Mansor semuanya “diorenkan”.
Saya kurang pasti kalau Datuk Seri (tengku) Adnan Mansor juga “dibajuorenkan”. Tetapi rasanya tidak. Kalau tidak silap dia pakai baju seakan batik berwarna biru.
Banyak lagi kes SPRM yang menanti Najib dan Rosmah. Jadi kita tunggu dan lihatlah sama ada hasrat orang ramai melihat Najib dan Rosmah memperagakan seragam oren itu akan termakbul.
Hak Bersuara
Kemudian orang pun bertanya mengenai Najib yang terus membuat kenyataan seolah-olah dia masih Perdana Menteri dan keengganannya masuk kandang tertuduh ketika sesi pengurusan kes di Mahkamah Sesyen Kuala Lumpur 16 November lalu.
Berkenaan Najib membuat kenyataan, saya rasa itu hak dia lah. Dia masih bebas dan kita pun menghormati kebebasan bersuara. Nasihat saya, kalau mual dan loya tak payahlah baca komen dia.
Ini cerita orang takut hantu ketika berseorangan pada malam gelap gelita. Lagi takut, lagi kuatlah dia menyanyi atau bercakap sendirian.
Bersabit keengganan dia masuk kandang tertuduh pula, ada orang, termasuk peguam kata, perbuatannya itu menghina mahkamah. Orang putih kata “contempt of court”.
Penyelidikan saya mendapati bahawa di bawah Perkara 26 Jadual Ketiga (Seksyen 99A) Akta Mahkamah Rendah 1947, sabit tuduhan menghina mahkamah  boleh dikenakan hukuman penjara maksimum tiga minggu atau denda.
Tapi saya rasa keengganan masuk kandang itu dibuat untuk menguji kesabaran hakim dan mencabar peraturan mahkamah.
Adalah kebiasaan dalam perbicaraan bagi orang kena tuduh dan peguam mereka menggunakan pelbagai tipu helah dan isu teknikal bagi melengahkan perbicaraan dan sekali gus mencetuskan keraguan.
Kita telah tengok bagaimana kaedah ini digunakan secara berleluasa dalam kes-kes berat atau sensasi, khususnya yang membabitkan orang politik dan orang kenamaan lain.
Silap-silap tertuduh sakit perut, sakit jantung, sakit mata dan macam-macam lagi. Kemudian tukar peguam. Lepas itu bantah itu dan ini.
Mahkamah Teliti
Proses mahkamah lazimnya perlahan kerana mahkamah perlu teliti. Ada empat peringkat mahkamah yang perlu dilalui sebelum seseorang itu menjalani hukuman.
Dalam kes Najib ini sudah pasti dipindahkan daripada Mahkamah Sesyen ke Mahkamah Tinggi. Dengan takdir dia didapati bersalah oleh Mahkamah Tinggi, dia boleh merayu kepada Mahkamah Rayuan. Kalah di Mahkamah Rayuan merayu pula kepada Mahkamah Persekutuan. Kalau kalah juga barulah masuk penjara.
Jadi, nasihat saya, kita jangan terlalu sangat menaruh harapan hendak tengok Najib, Rosmah dan sekutu mereka dicampakkan ke dalam penjara dalam masa yang singkat.
Kalaulah ditakdirkan Pendakwa Raya menang, saya rasa kita berikan sedikit keistimewaan kepada Najib.
Kita benarkan dia dibawa ke Penjara Sungai Buloh atau Kajang dengan menaiki MRT kerana kebetulan dia memilih membina MRT di antara Sungai Buloh dan Kajang yang kedua-duanya ada penjara.
