Anwar Ibrahim Diampun Tak Ikut Perlembagaan Persekutuan

Jelas di sini bahawa pengampunan yang diberi kepada Anwar adalah tidak sah kerana ianya tidak mematuhi Perlembagaan Persekutuan. Jadi apa yang Lim Guan Eng cakap ni? Takkanlah seorang menteri kabinet pun tak tahu undang-undang atau pun dia buat-buat tak tahu?

Nampak gayanya Lim Guan Eng tidak menghormati langsung pada Perlembagaan Persekutuan (baca berita di bawah). Anwar Ibrahim diberi pengampunaan bukan atas desakan atau cadangan daripada Peguam Negara atau Lembaga Pengampunan tetapi diatas desakan daripada Perdana Menteri Tun Dr Mahathir Mohamad sendiri.

Yang sepatutnya, Peguam Negara perlu mencadangkan kepada Lembaga Pengampunan yang diketuai oleh DYMM Yang di-Pertuan Agong untuk pengampunan Anwar Ibrahim, bukannya Perdana Menteri Tun Dr Mahathir Mohamad. Tetapi, Peguam Negara Mohamed Apandi Ali telah dibuang pada 15 Mei 2018 dan Tommy Thomas mengambil alih pada 4 Jun 2018. Manakala Anwar pula diberi pengampunan pada 16 Mei 2018.

Perkara ini amat jelas terkandung didalam Perlembagaan Persekutuan.

PERLEMBAGAAN PERSEKUTUAN

Power of pardon, etc.

42. (1) The Yang di-Pertuan Agong has power to grant pardons, reprieves and respites in respect of all offences which have been tried by court-martial and all offences committed in the Federal Territories of Kuala Lumpur, Labuan and Putrajaya; and the Ruler or Yang di-Pertua Negeri of a State has power to grant pardons, reprieves and respites in respect of all other offences committed in his State.

(12)(b) Notwithstanding anything contained in this Constitution, where the powers mentioned in this Article—

(i) when attending any proceedings under this Clause, the Yang di-Pertuan Agong shall not be accompanied by the Prime Minister and the other Rulers shall not be accompanied by their Menteri-Menteri Besar;

(ii) before arriving at its decision on any matter under this Clause, the Conference of Rulers shall consider any written opinion which the Attorney General may have delivered thereon;

Jelas di sini bahawa pengampunan yang diberi kepada Anwar adalah tidak sah kerana ianya tidak mematuhi Perlembagaan Persekutuan. Jadi apa yang Lim Guan Eng cakap ni? Takkanlah seorang menteri kabinet pun tak tahu undang-undang atau pun dia buat-buat tak tahu?

‘Don’t you respect your own King?’ Guan Eng asks PAS MP

(MMO) – DAP secretary-general Lim Guan Eng accused PAS lawmaker Datuk Takiyuddin Hassan of disrespecting the monarchy by claiming Malaysia would have an ex-convict as its next prime minister.

Lim, who is also finance minister, criticised the Kota Baru MP for heaping shame on those who have been cleared of wrongdoing.

He said Takiyuddin was disrespecting Kelantan Ruler Sultan Muhammad V, who had granted a full pardon to Datuk Seri Anwar Ibrahim in May 2018 when he was Yang di-Pertuan Agong.

“Does he not respect the former DYMM YDP Agong and the Tuanku Sultan of his own state?

“A full pardon had cleared of criminal records and Anwar is no longer a convict. Does a lawyer not understand this? Who is opposing the King now?” Lim tweeted this morning, attaching a screenshot and link of a news report citing Takiyuddin’s remarks.

The PAS secretary-general was reported by news portal Malaysiakini as saying that even when a person is freed from prison, he is known as a former convict for the rest of his life.

Takiyuddin, trained as a lawyer, said no one should question the Federal Court’s sodomy conviction and jail sentence on Anwar because the decision was made by a panel of five judges and not just one.

The ruling Pakatan Harapan (PH) coalition has named Anwar to succeed Prime Minister Tun Dr Mahathir Mohamad mid-term as part of its leadership transition plan.

Anwar was freed and pardoned on May 16 after PH bested Barisan Nasional in the last general election.

The PKR president has been jailed twice on sodomy convictions and also for abuse of power.
