Ain, father sued for defamation over lewd joke claim
Oriole: There is an extreme irony here. A teacher is one who shapes values, integrity and morality. Here you have one who is alleged to have made light of a criminal behaviour and even appeared to be grooming that criminal behaviour.
Teachers have a serious impact on their charges; so how would this message have been received by impressionable young males in his class?
And yet, when called out on this behaviour, instead of making amends and moving on, he behaves like some outraged party that has been wronged.
And by their current silence, it looks like the Education Ministry condones this. So, this is the pathetic state of education and this is what we have become.
A country that discriminates, grooms the young to criminal acts, and bullies victims and whistleblowers, is on a downward spiral.
Anonymous 080: As far as I can remember, Ain Husniza Saiful Nizam didn't name the teacher.
So, it looks like Khairul Nizam Sanuddin (a teacher at PJPK SMK Puncak Alam) termakan cili and will have a tough time proving he was the one mentioned on video unless he is backed by certain individuals in the background who help fund his legal case.
Appum: Well, this teacher has taken this issue into the public domain by such litigation. I am sure he has been advised wrongly.
The public, as shown here, are all behind Ain and her father with the exception of a few. Surely, she would be able to raise more than sufficient funds to fight her case. It looks like a "David vs Goliath" situation whereby this teacher thinks he is Goliath.
And in litigation, more dirty linen will be aired and this teacher must be prepared to receive them. Worst of all, he may suffer more with the possibility of a counter suit.
Now, he is also dragging the Education Ministry, the government, and the Education Department into this mud fight.
Obviously, he has never given any deep and serious thought on the repercussions and implications of such a legal move (and his future career).
Malaysia Bharu: According to Khairul Nizam, he had given lesson on protection for children against sexual offences. He had explained "methods for self-defence in situations involving sexual assault, sexual harassment or rape".
He seems to be using the words “legal” and “law” to camouflage Ain's allegations about the joke on targeting women above 18 if men wanted to commit rape. It looks like a white-washing attempt to tarnish Ain and clear his name.
The law works for both the plaintiff and defendant alike. Ain has a strong case in that there is no reason for her to have put herself on the line and exposed this matter other than raising an issue of ethics and expressed her concern for the overall good of her fellow students.
This is an opportunity for Ain to put her case before the courts since the Education Ministry appears to have left her in the lurch. In fact, there could be negligence or misfeasance on the part of the ministry as it has remained silent on Ain's charges.
RakyatMalaysia: What a joke! This is happening because the Education Ministry failed to thoroughly investigate the claims and to settle the allegations. Their seemingly light-handed approach to the teacher resulted in this fiasco.
The bully becomes bolder, and bullies even more.
Ain and Saiful Nizam, we are with you. We sympathise with the emotional turmoil you are going through and will pray for you and support you financially to the best of our abilities.
Meanwhile, the Education Ministry should do something to protect our kids.
OrangePanther1466: Let's not try to act altruistic - do any of you really know the nature of the so-called rape jokes? You don't know, yet you crucify the teacher.
Let the case go to court and we find out what was actually said. The student started it by shaming the teacher and publicising it on social media.
Let's assess for ourselves if the teacher's mistake in making the joke warrants the kind of livid reaction from the student and her father. Action had already been taken by the Education Ministry but the student demanded more.
Did you all realise the overreaction? For a moment, I thought he actually raped her.
MerdekaMerdekaMerdeka: @OrangePanther1466, you’re missing the overarching issue here – rape must never be the theme for a joke, and a classroom is definitely not the place for a teacher to downplay the gravity of rape.
All those boys in that class are going to leave school eventually with the understanding that “raping women 18 year old and above is okay, as teacher had said.”
Your reaction should be like he had “raped” the mentality of all those students with his perverse and twisted views of rape. Yes, you must react as if he had committed rape.
Anonymous_8139: @OrangePanther146, I do not see any logic as to why a 17-year-old would hold such an intense grudge over the teacher and “defame” him... likewise, the poor father who supported her daughter.
Not to mention that we're living in a society where the investigative and judicial units in most instances would place the whistleblowers to live with extreme mental and financial pressure, just because they reported the wrong acts as advocated by some of these donkeys.
It sends a strong message to the public that it's not worthwhile to report wrongful acts. Rather, they should just swallow them.
SSMM: The Education Ministry seldom takes disciplinary action against errant teachers, such as interdiction, suspension or terminating their services.
The SOPs (standard operating procedures) are very stipulated clearly in Perintah Am Bab D. The most they can do is transfer them to other schools or to their district office. Serious action will be taken only if the courts found them guilty of a criminal offence.
The teacher is fully aware of his special position and dares to continue with his antics. - Mkini
