Medical Council to scrutinise judgment on Zulfarhan's death


 


The Malaysian Medical Council (MMC) will look into the judgment of the High Court in Kuala Lumpur on the death of Universiti Pertahanan Nasional Malaysia student Zulfarhan Osman Zulkarnian and determine whether any improvements can be made to its professional code of conduct.

MMC president Dr Noor Hisham Abdullah, who is also Health Ministry director-general, said this after the court found Zulfarhan's peers guilty of culpable homicide for inflicting burn wounds on him using a steam iron and also called out the doctor who failed to alert the authorities when treating Zulfarhan.

"At present, doctors are to abide by the rules laid down in the Code of Professional Conduct and Good Medical Practice guidelines, which are adequate to ensure safe and ethical practice.

"However, the MMC will go through the court's judgment in order to see if any improvement can be made," Noor Hisham told Malaysiakini.

The MMC governs ethical issues and professional misconduct involving medical practitioners.

Zulfarhan's peers who had tortured him had taken him to a private clinic instead of a public hospital, out of fear that the authorities would be alerted.

Judge Azman Abdullah had said Zulfarhan might not have died if the doctor had caught on to the signs of torture when treating him.

“The doctor should not have turned a blind eye and believed the deceased was involved in an explosion during training till he sustained burns on his entire body, including his penis and testes, but did not have a single mark on his face," the judge said.

The court ruled that Zulfarhan had died from the torture he suffered but found that the murder was not premeditated.

He died from 90 burn wounds from a steam iron used on him by his peers in 2017.

The six accused, Muhammad Akmal Zuhairi Azmal, Muhammad Azamuddin Mad Sofi, Muhammad Najib Mohd Razi, Muhammad Afif Najmudin Azahat, Mohamad Shobirin Sabri and Abdoul Hakeem Mohd Ali were all sentenced to 18 years in jail after being found guilty of culpable homicide not amounting to murder. - Mkini
