IS ROSMAH HIDING THE ‘GOOD STUFF’ & WHERE? IN SHOCK REVELATION, JEWELLER SAYS COPS UNABLE TO IDENTIFY THE 44 PIECES AMONG THE MASS OF JEWELLERY SEIZED SO FAR

PETALING JAYA – Questions have arisen as to how 44 pieces of jewellery worth RM60 million was brought into the country for Datin Seri Rosmah Mansor without a declaration to the Customs Department.
Rosmah, the wife of former prime minister Datuk Seri Najib Abdul Razak, had admitted in court documents sighted by theSun that she or her agents had received the jewellery abroad and that it had been brought into the country.
Finance Minister Lim Guan Eng had said there was no import declaration made to Customs regarding the delivery of 44 pieces of jewellery linked to Rosmah.
“From a check of the records available under the Customs information system for seven years, in line with the period of record keeping, it was found that no import declaration was made on the jewellery,” Lim said when winding up the debate on the motion of thanks for the Royal Address for his ministry at the Dewan Rakyat sitting on July 31.
According to sources, if the jewellery had not been declared when brought into the country, it could have been done either via a diplomatic pouch or smuggled in.
Lebanese Samer Hailimeh Hassib, the production and sales manager of Global Royalty Tradding SAL, in his affidavit-in-reply, said Rosmah had admitted receiving the jewellery abroad and he had no control over how Rosmah transported the jewellery back to Malaysia.
Whether or not Rosmah had complied with Malaysian laws, for example the Customs Act 1967, is an issue to be decided. In the event Rosmah had failed to comply with such laws, the jewellery may be subject to seizure, which would interfere with his rights over the jewellery, the affidavit stated.
Samer said Rosmah had attempted to strike out his suit by claiming the jewellery had been seized by the police under the Anti-Money Laundering Act, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.
He said to date, Rosmah has been unable to show the specific 44 pieces of jewellery had indeed been seized by the authorities nor had she demonstrated to have sought confirmation from police that the jewellery had been seized by them.
He said Rosmah has attempted to strike out his suit against her, by relying on Section 54(3) of the Act, which states: “For so long as a seizure of any property under this Act remains in force, no action, suit or other proceedings of a civil nature shall be instituted except with the prior consent in writing of the public prosecutor”.
Samer said it was incumbent upon Rosmah to show the jewellery had been seized before she can apply Section 54(3).
He also said in his affidavit that the attorney- general had sought to intervene in the case and this further amplifies that Rosmah does not qualify to use Section 54(3).
Samer said his company had not received a full list of the seized items from the police and as such, none of the stakeholders involved are aware of which party is currently in possession of the jewellery.
He added that a letter from the Bukit Aman Commercial Crime Department stated that the department was unable to identify the jewellery among the items seized from Rosmah.
