KUALA LUMPUR: Datuk Seri Najib Razak’s former special officer, who uploaded closed circuit television (CCTV) footage of proceedings of the ex-premier’s graft trial to his Facebook page on Friday, has defended his action.
In his Facebook status update today, Isham Jalil insists that he is not in contempt of court for publishing the Court Recording and Transcription (CRT) video, as the general order of the court “only prohibits unapproved live telecasts and personal recordings of proceedings”.
“The video which was uploaded (on Friday) was neither a live telecast nor a personal recording. It was recorded by the court using the CRT system and not by any other party.
“Videos recorded by the court for CRT are not the same as personal recordings of proceedings.
“In the United Kingdom, CRT video of a court proceedings can be considered a written transcript that could be obtained by the people from the British National Archives,” said Isham, who added that the situation is similar in other developed countries.
His latest post was accompanied by another CRT video of the trial.
“As for now, there is no written regulation on the CRT video of a court proceeding in Malaysia.
“I find it strange that PH (Pakatan Harapan) lawyers do not understand or are unaware about this,” he added.
Isham described the proceedings involving Najib as a public hearing and not an official secret.
He also maintained that the trial is a high-profile case and a matter of public interest. The people, he said, have the right to follow the proceedings openly or with minimum restriction.
“Why was the inquest involving the late Teoh Beng Hock made live, and not the proceedings involving Najib, since both are considered public hearings and matters of public interest?” he said.
However, Parti Pribumi Bersatu Malaysia (Bersatu) legal bureau committee member Saiful Ambar Abdullah Ambar is not convinced, as said that a police report will be lodged against Isham.
Saiful said the uploading of the recording and comments posted by Isham are clearly against the law and that it is a clear act of contempt of court, as the trial is ongoing. – NST
Court to deal with issue of Najib’s trail footage uploaded to social media platform
KUALA LUMPUR: Police will open an investigation under the Police Inquiry Paper regarding the viraling of a CCTV camera recording of the trial proceedings of former prime minister Datuk Seri Mohd Najib Tun Razak which was uploaded in the social Facebook website.
Kuala Lumpur police chief Datuk Seri Mazlan Lazim said prior to that, the police would make a first information report’ (FIR) on the investigation as no one had come forward to lodge a police report so far.
“The report made was to obtain initial information to enable investigation to be initiated on the spread of the video recording.
“Police will investigate to see what are the offences committed,” he told reporters after the friendly programme with residents of Segambut at Taman Sri Segambut here today.
Also present at the programme was the Deputy Minister of Family, Women and Community Development Hannah Yeoh.
Meanwhile, Mazlan called on the people to come forward and share any information concerning crime with the police.
He said members of the public should share information on crime with the police instead of viralling the information on the social website.
“We want information from members of the public in various forms such as through the application Volunteer Smartphone Patrol (VSP) on the smart phone or contact the Kuala Lumpur Police hotline number 03 2115 9999 and the police will respond within 15 minutes,” he said in his speech at the gathering.
On Friday, a video with a duration of two minutes 12 seconds titled ‘Hari kelima perbicaraan Datuk Seri Najib’ (Fifth day of Datuk Seri Najib’s trial) showed the recording of Najib’s defence counsel Tan Sri Muhammad Shafee Abdullah questioning a witness which went viral on the social website.
It was learnt that the recording was uploaded via the account of Najib’s former special officer Isham Jalil at noon yesterday and had been viewed more than 227,000 times, shared by more than 3,700 Facebook accounts and received more than 1,900 comments.
Through the title uploaded by Isham, it was believed that the CCTV recording was taken during the fifth day proceedings of Najib’s trial at the Kuala Lumpur Court last Thursday. – BERNAMA
