Anwar’s application on ‘black eye’ incident turned down
PUTRAJAYA: The Federal Court has turned down Anwar Ibrahim’s application to include former policeman Ramli Yusuff’s testimony on the 1998 ‘Black Eye’ incident in his Sodomy 2 review.
The five judge panel, led by Chief Judge of Malaya Justice Zulkefli Ahmad Makinudin, ruled in a unanimous decision that Anwar’s application lacks merit.
“The application is not sustainable under Section 93 of the Courts of Judicature Act,” said Justice Zulkefli. “We are of the view that the application for additional evidence does not pass the threshold of Section 93.”
Other judges in the panel included Chief Judge of Sabah and Sarawak Justice Richard Malanjum and Justices Hasan Lah, Abu Samah Nordin and Zaharah Ibrahim.
Previously, in a lawsuit by lawyer Rosli Dahlan against the Malaysian Anti Corruption Commission (MACC) for allegedly malicious prosecution, former Bukit Aman criminal investigation chief Ramli Yusuff had testified that he was asked to fabricate evidence by then Inspector-General of Police (IGP) Musa Hassan on the infamous “Black Eye” incident. He was allegedly urged to make a false police report against Anwar’s police report implicating former IGP Rahim Noor and to arrange a doctor to give a false report that the de facto Opposition Chief (Anwar) inflicted the eye injury on himself.
“I refused,” said Ramli. He added that he was subsequently seen as “disloyal” by Musa and then Attorney-General Abdul Gani Patail.
Rosli settled his lawsuit last month with MACC when the anti-graft body “expressed regrets” over what he had to go through in being arrested and charged for allegedly failing to declare his assets in October 2007.
On Feb 10 last year, the Federal Court upheld the Court of Appeal decision to convict Anwar for allegedly sodomising his former assistant and aide Saiful Bukhari in 2008.
He’s serving a five year jail sentence.
