Apandi Ali wants judicial reviews against him ‘merged’

apandi-ali_law_600_1KUALA LUMPUR: Attorney-General (AG) Mohd Apandi Ali wants all three judicial reviews, challenging his decision against prosecuting Prime Minister Najib Abdul Razak for alleged wrongdoing relating to 1MDB, SRC International and a RM2.6 billion donation controversy, to be heard together.

The judicial reviews were filed by former de facto Law Minister Zaid Ibrahim, sacked Umno Batu Kawan deputy divisional chief Khairuddin Abu Hassan and the Malaysian Bar.

Senior federal counsel Shamsul Bolhassan said Apandi wants all three judicial reviews, challenging his decision not to prosecute Najib, to be heard together. “This was because of one similarity in the three judicial reviews, to quash his no prosecution decision.”

“Justice Hanipah Farikullah will hear the application by the AG on May 15 on whether to combine all three judicial reviews,” he said.

Shamsul added that both the Bar Council and Khairuddin did not object to hearing their judicial reviews together. “However, Zaid does not agree.”

Zaid said in a statement on February 2 that he filed an application for a judicial review to get an order to set aside the decision of the AG on not to prosecute Najib and the order he made to the MACC to close their investigations.

He also wants to compel the AG to exercise his discretion under Article 145(3) to properly consider instituting criminal proceedings against Najib for alleged wrongdoing.

Further, he wants a declaration that the decision of the AG in compelling the MACC to close its investigations on the matter was ultra vires the AG’s power under Article 145(3) of the Federal Constitution.

Khairuddin also filed a similar judicial review seeking to quash Apandi’s decision on not prosecuting Najib on the donation controversy, and alleged abuse of powers in transferring funds from Kumpulan Wang Persaraan to SRC International.

The Bar Council’s judicial review was to set aside the AG’s decision to close investigations on the RM2.6 billion donation issue and the alleged transfer of funds from SRC International to the Prime Minister’s accounts.
