No need for IGP to testify in Bersih chief's suit against Jamal, court rules

The Kuala Lumpur High Court has ruled that inspector-general of police Mohd Fuzi Harun had no knowledge of Bersih chairperson Maria Chin Abdullah's detention under the Security Offences (Special Measures) Sosma Act 2012 last year.

In view of this, Justice Mohd Zaki Abdul Wahab dismissed a subpoena for Fuzi to testify as a witness for Sungai Besar Umno leader Jamal Md Yunos (photo).

Justice Zaki made the decision in chambers this afternoon and made no order as to costs.

Jamal, who is facing a defamation suit from Maria, intended to call six witnesses including Fuzi, former IGP Khalid Abu Bakar, and former prime minister Dr Mahathir Mohamad.

Fuzi was director of Special Branch before being appointed as IGP succeeding Khalid on Sept 4 this year.

Jamal was represented by counsel V Mugunthan. Senior federal counsels Ahmad Terriruddin Mohd Salleh and Habibah Harun appeared for Fuzi, and Shahid Adli Kamarudin for Maria.

Mugunthan told reporters that he would seek instruction on whether to appeal today's decision.

It was reported last week that Ahmad Teriruddin told the judge in his submissions that Fuzi did not know anything about Maria's arrest, as it was carried out by another division within the police force.

Maria filed the suit following Jamal's claim that Bersih was infiltrated by Islamic State. Jamal made the allegation on Sept 28 and Oct 4 last year.

Following today's decision, the hearing of Maria's suit is scheduled for Jan 15 to 19.- Mkini
