Aulong assemblyman files suit against Perak Speaker

IPOH: Aulong DAP State Assemblyman Leow Thye Yih today filed a suit against Perak State Legislative Assembly Speaker SK Devamany and the state government over his recent suspension.

Leow filed the suit at the High Court Deputy Registrar’s office here at 3.27pm through Messrs Leong & Tan.

Among others, Leow applied for a declaration that the suspension of his salary, including allowance and claims ,for the period between April 1 until April 30, did not follow the provisions of the Perak State Constitution.

He also applied for a declaration that he had a right to all retirement and other allowances and/or benefits accorded to him under the Perak State Constitution.

The plaintiff also applied for related costs and relief or others deemed fit and suitable by the court.

Leow said one reason for the suit was that Devamany’s decision as Chairman of the State Committee on Rights and Freedom was not in accordance with the Perak Constitution.

He added that his suit was also filed as the decision was made outside the jurisdiction of the committee and was therefore not valid and ultra vires, as well as not in compliance with the Standing Orders 72 and 78 of the Perak Legislative Assembly.

Present were Taiping MP Nga Kor Ming (DAP), Sitiawan assemblyman Ngeh Koo Ham (DAP), Changkat Jering assemblyman Mohamad Nizar Jamaluddin (Parti Amanah Negara) and Buntong assemblyman A Sivasubramaniam (DAP).

On April 7, Devamany announced that Leow was suspended for one month from attending the Perak state assembly meeting, effective April 1.

The suspension of Leow was passed by the Perak Committee on Rights and Freedom against the state assemblyman because he was found to have made a malicious accusation against another assemblyman during the last sitting.

He said the one-month suspension, which was in accordance with the Standing Orders 36(3)(a) and 36(3)(b), was the longest in the history of the Perak state assembly.
