Court orders prosecutors to index 13k documents in LGE case
High Court judge Hadhariah Syed Ismail had in Chambers, ordered lawyers on both sides to sync their document submissions according to standard practice.
This was relayed to reporters by lead defence counsel Gobind Singh Deo.
“They just gave us one disc and when we printed out the pages, it was devoid of an index. It also took us 10 days to photostat all 13,000 pages.
“This is the first time I have got documents of this magnitude handed over to me without an index.
“There are a lot of pages missing, it is also blur, possibly due to poor scanning. The honourable judge has instructed them to produce proper paginated, indexed documents by Dec 6,” Gobind said in a press conference at the Town Hall.
Gobind explained that it was important for the documents to have an index so that it is easily accessible during cross examination during trial.
“That way all parties would view the same page when the document is adduced in court.
“So we need not waste time looking for a particular page when all parties have the same set of documents, same page numbers and index as well.
“If this is not done, we would have to stand down often to search for a particular page and this would be cumbersome,” he added.
On June 30, Lim was charged with using his public office or position to obtain gratification for himself and his wife, Betty Chew, by approving an application by Magnificent Emblem Sdn Bhd to convert agricultural land for residential purposes during a state exco meeting on July 18, 2014.
Lim was also alleged to have used his position to obtain gratification by purchasing a bungalow from businesswoman Phang Li Koon for RM2.8 million, below the property’s market value of RM4.7 million on July 28, 2015.
He claimed trial to both charges.
