India to submit fresh request for red notice on Zakir Naik to Interpol
PETALING JAYA: India’s National Investigation Agency (NIA) is submitting a fresh request to Interpol to issue a red corner notice (RCN) against controversial preacher Zakir Naik.
The fresh request is being made after Interpol rejected an earlier submission from the NIA, saying that it was “premature” and that India had jumped the gun, the Times of India reported.
A red notice is used to inform all Interpol member countries that the person on the list is wanted based on an arrest warrant or equivalent judicial decision issued by a country or an international tribunal.
The red notice would have restricted Naik’s international travel.
In cancelling NIA’s request, Interpol had said that a red notice was to facilitate a country to seek the extradition of an accused charged for an offence, not a suspect merely under investigation.
However, it said, no formal charges had been filed against Naik. This, Interpol noted, was the basic requirement for seeking someone’s extradition according to the Indian government’s own rules.
“At this stage of the proceedings, the issuance of a red notice for the applicant’s arrest with a view to his extradition is premature,” the Times of India quoted Interpol’s commission for the control of Interpol files as saying in its October decision.
Following the rejection of the red notice request, Interpol had also told police agencies in different countries to remove information relating to the preacher from its database that it, or India, might have sent to them.
NIA, however, clarified that Interpol had not accepted the request to issue a red notice against the controversial Islamic preacher as the intelligence agency had not filed a charge sheet for Naik’s arrest.
The agency has already moved the court for a charge sheet against Naik and would once again petition Interpol for a RCN, it said.
Naik had caused a stir in Malaysia when it was reported earlier this year that he was given permanent residence (PR) status by Putrajaya about five years ago.
Indian authorities have accused the controversial Islamic preacher of funding terrorism.
Naik was charged with heading an “unlawful association” and inciting youths to commit acts of terror and join global outfits such as the Islamic State (IS).
The NIA had said that Naik had also “deliberately insulted” the religious beliefs of Hindus, Christians and Islamic sects like Shia, Sufi and Barelvi, and that his speeches had influenced recruits to the IS cause.
Deputy Prime Minister Ahmad Zahid Hamidi had said the government would send Naik back if there was a request based on Mutual Legal Assistance by the Indian government.
Confirming that Naik had not applied for Malaysian citizenship, Zahid added however, that there was no reason to review the Islamic preacher’s PR status. - FMT
