Dates importer files ‘GST’ lawsuit against Customs Dept, MOF

KUALA LUMPUR, July 20 — A dates importer and distributor has sued the Royal Malaysian Customs (RMC) and Finance Ministry (MOF) in relation to the implementation of Goods and Services Tax (GST) on dried dates.

Asia Kitchen Sdn Bhd filed the suit through its lawyer, Datuk Abu Backer Sidek of A.B Sidek & Co at the High Court registrar’s office here on June 17.

The company, involved in importing and distributing dates from Saudi Arabia, named the RMC and MOF as first and second defendant respectively.

Abu Backer told reporters when met after the proceeding before High Court deputy registrar K. Pavani today, that his party delivered the writ of summons to the defendants on Monday and Aug 3 was set for the case management.

In its statement of claim, the company demanded the defendants to justify the GST imposed on its dried dates.

The plaintiff claimed that the defendants’ action was a form of injustice and victimisation which had burdened not only the plaintiff but also other parties who had to bear the high cost of living.   The company also applied for an order for basic products and services to be exempted from the GST.

It further applied for GST exemption for dried dates which is ‘sunnah’ (practice by prophet Muhammad) food for Muslims.

In addition, the plaintiff is also seeking an order for the list of fruits and vegetables, list of taxable and non-taxable goods, third edition to be amended, and GST exemption for dried dates, similar to the provision for wet dates. — Bernama
