PAS is looking to postpone its proposed amendments to the Syariah Courts (Criminal Jurisdiction) Act 1965, or Act 355, in the forthcoming Parliament sitting.
PAS Ulama chief Mahfodz Mohamed said his party wants to ensure that there is sufficient support for the proposed amendments to be passed in Parliament.
“Therefore, we need to consider that even if Umno and other Muslim MPs will not support it, then it would be best to postpone it,” Mahfodz told journalists after an Islamic lecture in Gombak, Selangor, today.
He believes his party will win “many seats” in the next general election to give it the numbers to push through the proposed amendments.
“After the general election, after we win many seats, then we can (table the Act 355 amendments in Parliament),” he said.
PAS aims to contest 100 parliamentary seats
For this reason, Mahfodz said, PAS is looking to contest 100 parliamentary seats in the coming general election, the 14th for the country.
“Our target is to maintain our seats in Kelantan, in Selangor and retake Terengganu and Kedah, on top of winning more seats elsewhere,” he said.
However, Mahfodz said, there were no electoral negotiations with Umno.
In May last year, Minister in the Prime Minister’s Department Azalina Othman Said surprised Parliament when she requested to prioritise the motion from PAS president Abdul Hadi Awang (photo) on his private member’s bill on the amendments.
Hadi’s motion sought leave to amend Act 355 by removing the punishment cap that can be meted out by the Syariah Court, which currently stands at three years of imprisonment, RM5,000 fine and six strokes of the rotan.
Umno leaders, including Deputy Prime Minister Ahmad Zahid Hamidi, had expressed support for the move and negotiated a deal with PAS to raise the cap to 10 years’ imprisonment, RM100,000 fine and 100 strokes of the rotan.
There were also suggestions that the government takes over the proposed amendment.
However, Umno’s partners in BN, including those in East Malaysia, voiced fierce protest, prompting Prime Minister Najib Abdul Razak to promise that the government would not table the proposed amendment.
The proposed amendments have progressed slowly, with multiple deferments and an updated version was tabled in Parliament in April.
It was again deferred in the last Parliament sitting in July and based on Mahfodz’s indication, the motion to amend Act 355 will likely be deferred in the forthcoming Parliament sitting, which will commence on Oct 23.
