Ex-CJ: No law prohibiting "Muslim-only" laundrettes

There is no law prohibiting a laundrette owner from putting up a sign that says "Muslim only" said former chief justice Abdul Hamid Mohamad.

"As far as I remember, I have never come across a legal provision in Malaysia that says this (putting up a Muslim only sign) is against the law. Please show me if there is," wrote on his blog on Friday.

He added that a constitutional provision against discrimination "does not apply to individuals", only the government.

He cited Clause 1 of Article 8 which states: "All persons are equal before the law and entitled to the equal protection of the law."

He also cited Clause 2 of the same article which states: "Except as expressly authorized by this Constitution, there shall be no discrimination against citizens on the ground only of religion, race, descent, place of birth or gender in any law or in the appointment to any office or employment under a public authority or in the administration of any law relating to the acquisition, holding or disposition of property or the establishing or carrying on of any trade, business, profession, vocation or employment."

"Notice how each prohibition has nothing to do with individuals. 

"A laundrette owner is a businessperson. They can choose to deal with who they want. They don't have to give any reasons to anyone," he said.

The issue of Muslim only laundrettes caught public attention when a photo of one such establishment in Johor went viral.

Johor's Sultan Ibrahim Sultan Iskandar expressed his displeasure at the practice and ordered the laundrette owner to open his business to all or be shut down.

Abdul Hamid, however, said a laundrette-owner can't be blamed for doing a Muslim-only business if it means that he can get more customers.

He said one way to achieve the same effect would be to put up a sign that says that the washing machines can't be used to clean undergarments by those who do not clean themselves with water after defecating, or to clean any clothing that may have come into contact with dogs or pigs.
